Charities to be in breach of Equality Act?

Charities may find they have breached the Equality Act without realising it when the legislation comes into force in October, a working party has identified. Members of the Charity Law Association told civilsociety.co.uk that causes will need to prove there is a legitimate aim for the restrictions imposed on those they choose to benefit.
Failing to do this could mean they face challenges under the Act, so the Charity Commission needs to address the issues before they become burdensome. The group wrote: "Many charities may not realise they are potentially breaching the law until a claim is brought, leading to significant costs and potentially damage to the reputation of the charity and the sector."
The members highlighted that charities may be confronted with requests to change their mission statements if they are unable to provide good reason for deciding to benefit some groups rather than others.
The Equality Act brings together a number of existing laws relating to discrimination into a single piece of legislation.
