Corporate manslaughter trial postponed
04 March 2010![]()
The first case to be tried under the UK's Corporate Manslaughter Act 2007 has been postponed.
The judge in the case has delayed the trial until October because the Director of the company charged with the crime, Cotswold Geotechnical Holdings, needs urgent medical attention. The trial was due to begin at Bristol Crown Court on 26 February 2010 and had already been pushed back from 23 February due to defendant Peter Eaton's ill health.
The company is charged with health and safety breaches following the death of a 27-year-old employee Alex Wright, who died when the trench he was working in collapsed. Mr Eaton also faces a charge of gross negligence manslaughter relating to the incident and could face life imprisonment if he is found guilty.
The landmark law, which came into force on 6 April 2008, established the criminal liabilities of companies where serious failures result in a fatality. The Health and Safety Executive believes that the legislation adds an important element to corporate responsibility.
