Recovering possession of premises: case report

B P Collins successfully acted for a local tyre dealer in recovering possession of premises from a rival dealer at their site in Buckinghamshire.
Our client owned the freehold of the site and it was leased under a protected Landlord and Tenant 1954 Act lease to the rival firm.
B P Collins served notice upon them of the intention to resume occupation of the property and trade from the site.
The Tenant issued Court proceedings for a new lease in dispute of this notice and following negotiations between solicitors acting for the parties the proceedings were stayed and our client was able to reoccupy the premises.
