The Lincolnshire Law Society has called for the will writing industry to be better-regulated, following a case in which two men were jailed. David Nash and Nicholas Butcher of the company Willmakers of Distinction received three-and-a-half-year prison sentences after they were found to have stolen money from the estates of their clients.
Society President Paul Sheridan said the example of "callous fraud", which he admitted is rare, nevertheless indicates the need for regulation to ensure those who want to make a will or their beneficiaries are not cheated out of money. "We also continually hear of cases where clients of will-writing firms have been attracted by low headline charges only to find their final bills vastly inflated by large 'hidden' costs," he said.
It would be "extremely unfortunate" if the case discouraged anybody from making a properly drawn-up will, added Mr Sheridan. He emphasised the importance of consulting a professional and qualified solicitor to draft a will.
