B P Collins acts swiftly to limit damage to IT business
B P Collins LLP acted on behalf of a leading IT support services provider on an employment matter related to the departure of two members of its sales team to a competing business.
The client discovered that one of the two exiting staff had been diverting customer orders to an employee of the rival business.
They also discovered that the employee had also attempted to download the entirety of the clients customer and pricing database to a cloud-based file hosting service account, posing a significant risk to the client’s business. Therefore it was vital that the employment team acted immediately to limit any damage.
Chris Brazier, associate in the employment law practice group, advised with letters before action threatening injunction proceedings against the employees. Chris also advised the client on the dismissal of the employee in question.
At the point where injunctive relief proceedings were contemplated, undertakings from the rival business and from the (now former) employee were received. Following an assessment of the situation and lengthy discussions, the client chose to not issue proceedings.
