B P Collins negotiates complex agreement for professional certification organisation
The employment law team at B P Collins LLP has advised and acted for a client on a number of day to day matters, as well as more complex issues involving the former senior executive of the organisation.
The chairman had attempted to create a joint venture on behalf of his new company with a joint venture partner in Asia – arguably using confidential information gained during his directorship at the company. As such, awareness of the opportunity stemmed from his employment with our client.
Matters were further complicated by issues arising from a sponsored employee, a relative of the CEO of the company in Asia, who promptly resigned. Seemingly the sponsored employee had been working on the proposed new joint venture whilst employed by the client.
Associate, Chris Brazier wrote to both the former senior executive and the former employee, outlining the breaches caused by their actions, seeking undertakings.
Ultimately, after negotiation, a commercially acceptable agreement was reached.
