Prime contractor achieves successful settlement
Following its engagement as prime contractor in significant refurbishment works at a public house, one of the country's leading specialists in public house and leisure refurbishment instructed the litigation and dispute resolution practice at B P Collins LLP to resolve a dispute with a sub-contractor.
Despite payment in advance, the performance of the sub-contracted works was delayed without explanation following which the sub-contractor ceased communication. As a result of this, and the sub-contractors admission that it did not have sufficient capacity to complete the work, our client was forced to undertake the sub-contracted work itself, at extra cost.
Lead lawyer in the case, Simon Carroll (associate), reached a successful conclusion for all involved, commenting: "In the current climate, it's important to look at the bigger picture in litigious cases of this nature.
"Having successfully engineered a settlement for repayment of sums paid on behalf of our client, both parties were able to maintain a commercial position, leaving the possibility open to re-establish a business relationship in the future."
