Jonothan Moss, principal lawyer in the dispute resolution team, has persuaded the police to exercise their powers under Section 61 of the Criminal Justice and Public Order Act 1994 to serve notice and evict an unauthorised encampments from the car park of a business in High Wycombe.
Initially the police decided not to exercise their powers, which was leading to a loss of revenue to the company, together with disruption and anti-social behaviour to staff and customers.
Jonothan reviewed the initial decision and a pro-active stance was taken to hold the police to account for their initial decision until they eventually concluded that the situation was now intolerable and unjust for the company and other local people.
What is perhaps of great concern is that when the encampment was initially reported to the police on the 101 number, the advice received from the police was the only way to remove the Encampment was to instigate long winded and expensive litigation.
The company was never advised by the police of other, more efficient and quicker solutions to the problem, which involved the use of police resources.
A detailed knowledge of this area of complex law, together with a very hands-on and committed strategy has removed, for the company involved, a great deal of stress and anxiety within 48 hours of instruction.
