B P Collins appoints asssociate Jemimah Fleet to the family team
B P Collins is delighted to announce that Jemimah Fleet re-joins its family team today (6 August 2019). Jemimah qualified in 2012 and her return strengthens B P Collins’ existing wealth of experience in family law, but also enables the firm to offer specialist legal advice in surrogacy and fertility for the first time.
On Jemimah’s appointment, Sue Andrews, head of B P Collins’ family team says:
“We’re delighted about Jemimah’s return. She has a natural flair in dealing with all matters arising upon the breakdown of relationships, but now has experience in the area often referred to as “modern parenting,” which is a highly emotional and sensitive area. This means that B P Collins is able to advise the increasing number of people turning to surrogacy to have a baby or the surrogate herself.
“Jemimah’s appointment also allows us to strengthen our expertise in international adoption work.”
Jemimah joins the firm at an important time, when surrogacy law is about to experience a huge shakeup for the first time in 30 years, following a Law Commission consultation. The proposal is to allow intended parents to become a child’s legal parents as soon as he or she is born, subject to the surrogate retaining a right to object for a short period after the birth.
This would replace the current system, where the prospective parents must apply to court to become legal parents of the new baby, which cannot happen until the court grants them a parental order. This process can take months to finalise, a delay which is both frustrating and creates uncertainty.
The Law Commission aims to bring greater clarity to the surrogacy process, ensure the child’s best interests remain the key focus and provide reassurance to the surrogate and the intended parents.
