Mental Health Act unjustified detention

Jonothan Moss, principal solicitor in our dispute resolution criminal law team has challenged and successfully secured the release from a psychiatric ward of a client who was detained without justification under the Mental Health Act.

Any detention under the Mental Health Act is a significant restriction of a persons rights, remembering that usually the person detained has not committed any criminal offences. It is important, in appropriate cases, to review any decision to detain in order to establish whether the correct grounds and justification are indeed supported by the evidence.
