Why is an employment contract important?
Employment contracts are important because they set out many of the key rights between an employer and employee, including salary, bonuses, notice and holiday as well as rights the employer might have to require the employee to do (or not to do) certain things.
When should a new contract of employment be issued?
We would recommend that employers issue new contracts whenever employees get a significant promotion, as you may want to include different obligations in a contract for a more senior employee.
Where do I find my employment contract?
You should always keep a copy of your contract when you sign it. If you have lost it, then your employer should have a copy on file and you can ask them for it.
Can an employment contract be verbal?
In theory, yes. However, in practice, this is quite unusual. Employers are required to provide employees with certain written details about their terms and conditions of employment and in our experience, most employers will comply with this legal obligation.
Can an employment contract be changed?
Yes, although depending on the change, both employer and employee may need to agree on the amendment. Also, many employment contracts require that any changes are documented in writing, signed by both the employer and employee.
