Workforce management

Complying with employment law keeps your workforce happier and more productive and saves you the cost and stress of employment tribunal claims.

As an HR director or manager, achieving a balance between maintaining the rights of your staff and protecting the profitability of your business is a demanding and complex task. With increasing regulation and the cost of disputes continually rising, you need support at every level and expert legal advice tailored to suit your requirements.

Diverse caseload

Our employment lawyers cover a diverse caseload, acting for employers of start-up businesses, small and medium-sized enterprises and multi-national corporations. We help your management or HR team take a strategic view on employment law issues, to support both day-to-day business needs and long-term planning.

Whether reviewing your existing policies and procedures for compliance, ensuring your contracts are robust or advising on discrimination or unfair dismissal claims – we successfully handle all employment law issues, protecting you, your business and your people.

If you are uncertain whether your current policies and procedures are up to date, please do not hesitate to contact the employment law team to discuss how we can help.

IR35

IR35 (also known as the “off-payroll working rules”) is a set of regulations that are intended to make sure that employment taxes are paid where a consultant provides their services via an intermediary (usually their own personal services company) and is considered, for tax purposes, to be an employee of the end user business. Our employment law team have considerable experience in advising on IR35.

If you engage a consultant or currently provide your services as a consultant through an intermediary (such as your own personal services company), our clear advice is to act now to assess your engagements to see whether you fall within the rules.

For end user businesses, B P Collins can provide an onsite audit of your arrangements and give you a view as to whether an engagement falls within the rules and whether your agreement with your consultants should be restructured. Failure to do this could result in substantial tax liabilities and penalties for consultants and this liability could extend to the end user business.

If you are unsure about making a CEST Application or are considering a CEST Outcome and need an expert opinion, B P Collins can help.
