What to expect if you bring a claim
Tribunal cases are often emotionally charged. If you bring an employment tribunal claim, you can expect that the tribunal will make a series of case management orders, setting out a series of steps you must take to make sure the case is ready for hearing. Depending on the complexity of your case, the tribunal may list a preliminary hearing for case management to make sure that all necessary orders are made.
Typically, case management orders will include orders for both sides to disclose all relevant evidence to the other side, orders for agreement and preparation of a hearing bundle and for preparation of witness statements. The tribunal may make other orders too.
Case management orders must be complied with. A party that doesn’t comply risks having its claim or response struck out.
The final stage of your claim will be a hearing, at which all the evidence will be heard and the tribunal will decide whether your employer is liable or not.
