Employers process a huge amount of their employees’ personal data. Employees have a right to make a Data Subject Access Request (DSAR) to access their personal data. The response to a DSAR can be very revealing as it will often include information that you, as the employee, would not otherwise have access to, or even know existed.

What does a data subject access request solicitor do?

Making a data subject access request to your employer

Although a DSAR does not need to be made in writing or use specific language, making the request clearly and concisely identifying the relevant information you wish to access can help ensure that you get access to the information that you want.

After making your request, your employer has an initial deadline to comply of one calendar month, although this can be extended in narrow circumstances.

Complaints to the Information Commissioner

If an employer fails to comply with their obligations in relation to a DSAR, you may be able to make a complaint to the Information Commissioner. The ICO has a wide range of enforcement powers, including the power to issue a penalty notice imposing a financial penalty on the employer. The amount of the penalty will be assessed on a case-by-case basis.

On what grounds can you refuse a subject access request?
It is quite difficult for a data processor to refuse a subject access request. They might be able to decline if they can’t verify the identity of the person making the request. For employers, usually your identity will be obvious. There are also some limited exceptions.
Do I have to give a reason for a subject access request?
No.
Does a subject access request include text messages or emails?
Potentially, yes, if the text messages and emails include the requester’s personal data and are within the scope of the request.
