Our workplace disputes and grievances services

Workplace disputes and grievances can be stressful and disruptive to the workplace. At B P Collins, our expert work dispute solicitors provide clear, practical advice to help resolve conflicts quickly and fairly. Below are some of the areas we can help with.

Grievances

Sometimes, the best way to move towards resolution of a workplace dispute is to raise a formal grievance. Formal grievances allow employees to state their problem to an employer and request a resolution from them. B P Collins’ expert grievance lawyers can help you draft your grievance to put your best case forward and advise you on all stages of the grievance process, including grievance investigations, grievance outcomes and grievance appeals.

Victims of malicious grievances

Sometimes, employees abuse the grievance process by raising false grievances, exaggerated grievances or fabricated grievances against people they dislike. Victims of malicious grievances can often feel as if they have no support from their employer and that their job is on the line. If you are the victim of a malicious grievance, then taking advice at the earliest opportunity will allow you to come up with the best strategy for challenging the malicious grievance and maximise your prospects of successfully doing so.

Bullying and harassment at work

Bullying and harassment at work are a common source of workplace disputes and problems. Workplace bullying and harassment can be particularly difficult for the victim, especially if the bully is a line manager, boss or colleague with whom the victim has to work on a daily basis. Our dedicated employment law experts regularly advise victims of bullying and harassment in the workplace on their legal rights and help them to reach a satisfactory outcome.

How should I resolve a workplace dispute?
There is no one-size-fits-all answer here – it depends on the nature of your dispute and what has happened. Taking legal advice on your dispute can help you make sure you are in the best possible position to get an outcome with which you were happy.
What can be raised as a grievance?
In theory, any problem you have at work could be raised as a grievance. You will often have a choice of whether to raise your problem informally or formally. Raising a problem informally can be very effective, but sometimes the best course of action will be to raise your problem as a formal grievance.
How serious is a grievance?
If you raise something as a formal grievance, your employer should take it seriously. Most employers will have a grievance policy which sets out the steps they will take in relation to a formal grievance. This will normally include a formal investigation of your concerns as well as a right to appeal if you aren’t happy with the outcome.
What counts as bullying and harassment at work?
There isn’t a legal definition of bullying, but ACAS describes it is unwanted behaviour that is either (a) offensive, intimidating, malicious or insulting; or (b) an abuse or misuse of power that undermines, humiliates or causes physical or emotional harm to someone. There is a legal definition of harassment, which is unwanted conduct related to a protected characteristic that has the purpose or effect of creating an intimidating, hostile, humiliating or offensive environment for the victim. Some behaviour might be both bullying and harassment.
