Before April 2017, suspects of offences would be released on police bail, meaning they had a set date and time to return to the police station while further investigations were ongoing. However, the Policing and Crime Act 2017 ruled that people could be released under investigation even though the police investigation would still be ongoing and they would notify the suspect at some point in the future if they would be required for a further interview, given a notice of discontinuance or a summons to court.
Being released under investigation can lead to an anxious time, as there is no end date to the investigation. If you were unrepresented in your interview, you can instruct one of our solicitors to represent you. We will make contact with the officer and keep you updated. If you are invited back for a further interview, we will obtain the taped disks from your first interview, take your instructions and prepare you for the following interview. We will be in a position to see if witnesses need to be traced to take statements while the incident is fresh in their mind and secure any evidence that will strengthen your defence.
