What to expect if you bring a claim

If you bring an employment tribunal claim, you can expect that the tribunal will make a series of case management orders, setting out a series of steps you must take to make sure the case is ready for hearing. Depending on the complexity of your case, the tribunal may list a preliminary hearing for case management to make sure that all necessary orders are made.

Typically, case management orders will include orders for both sides to disclose all relevant evidence to the other side, orders for agreement and preparation of a hearing bundle and for preparation of witness statements. The tribunal may make other orders too.

Case management orders must be complied with. A party that doesn’t comply risks having its claim or response struck out.

The final stage of your claim will be a hearing, at which all the evidence will be heard and the tribunal will decide whether your employer is liable or not.

The Employment Tribunal may also offer a judicial mediation. A judicial mediation is an alternative way of resolving a dispute with your employer without the need to go to a full hearing. At a judicial mediation, an employment judge will act as an impartial mediator to see if mutually acceptable terms can be agreed for settlement of the case. Judicial mediations have an extremely high success rate, with published statistics stating that 65% of cases in which are mediated reach a successful settlement on the day of the mediation itself.

Are employment tribunal claims public?
Yes, after a certain point. Case management hearings are generally not public, but final hearings at which liability is determined will be public hearings. The Employment Tribunal publishes the judgments from all decided cases online. In very rare cases, the Employment Tribunal may grant an anonymity order safeguarding the identity of one or both parties. However, generally, the principle of open justice – which says that so far as possible court proceedings should be conducted in public and accessible to the public – prevails.
Why are so many employment tribunal claims withdrawn?
The main reason why someone might withdraw their employment tribunal claim is that the case has settled out-of-tribunal. When a case settles, then typically it will be a condition of settlement that the claimant withdraws their claim. In exchange, the claimant is usually paid a sum of money (although they may also receive other things like a reference).
How many employment tribunal claims are successful?
According to a recent survey*, the outcome of 27% of claims was the claimant succeeding at the final hearing of their case. However, that same survey reported that 62% of claims were settled out-of-tribunal before the final hearing. What claims can you make at an employment tribunal?
The employment tribunal has jurisdiction to hear a wide variety of claims, including unfair dismissal, discrimination in employment, breach of contract claims worth up to £25,000, claims for unpaid wages or holiday pay and claims for whistleblowing detriment.
